Historical scans are not necessarily consolidated current law. Confirm later amendments and school-specific applicability before relying on a provision. Understanding our educational heritage

The school takeover
of 1960–1961

The takeover is a sequence of legislation and school-specific decisions. Management, ownership, religious use and today’s school administration need to be considered separately.

Begin with the original legislation →

1960 Management

Act No. 5 of 1960 set the framework for the State to assume management of affected assisted schools, with provisions for exceptions and unaided schools.

1961 Property & safeguards

Act No. 8 of 1961 dealt with vesting and related matters. Sections 7(2), 25(3) and 33 are particularly relevant to religious use, instruction and places of worship.

School by school The record matters

Locate the school’s own vesting order, schedule and any later divesting order. The 1962 gazette in this collection illustrates why the exact school name and property boundaries matter.

A practical reading guide

Start with your question

01

Religious use of premises

For everyday questions

A useful place
to begin.

Open a question for a short explanation and the source to consult.

For a particular school or dispute, ask the Diocese and the responsible education authority to confirm the applicable position.

What did the 1960–1961 takeover change?
The 1960 Act established the management framework for affected assisted schools. The 1961 Act provided for property vesting through orders and related procedures. A school’s history alone does not establish its present legal status. Consult its specific orders, records and later changes. Read the Acts in the collection →
Can a taken-over school’s premises be used for religious activities?
Section 7(2) of the 1961 Act addresses qualifying religious use existing at the date of vesting, by a religious body owning an adjoining or nearby place of worship, outside the school’s educational and extra-mural use. It also limits which body may use the property for observance or worship. Establish the facts and obtain written clarification for the particular premises. Read section 7(2) ↗
Are religious instruction and worship the same in this law?
No. Section 33 of the 1961 Act distinguishes religious observance or worship from religious instruction during school hours. The same section excludes qualifying places of public worship and certain associated movable property from property liable to vesting. Read the definitions and their historical dates carefully. Read section 33 ↗
Does the Act mention schools solely for religious instruction?
Yes. Section 25(3) of the 1961 Act exempts schools solely for religious instruction from the preceding provisions of that section. This is a specific exception, not an exemption from every other applicable requirement. Read section 25 ↗
Can a school’s name, crest, motto or song be changed?
The Ministry’s Circular 13/2025 provides a process for school names and addresses identity items. Check sections 7.2–7.4, the school category, supporting records and the responsible authority before acting. Do not rely on one sentence of the English translation in isolation. Read the circular ↗
Which rule sets Catholic religion periods or teacher appointments?
This collection has not verified a current, universally applicable circular number or minimum pupil threshold for those questions. Request the current written instruction from the principal and the relevant Zonal or Provincial Education Office, with advice from the Diocese. Record the circular number, date, issuing authority and any amendments.
How can the Guild support teachers constructively?
The proposed Guild can support prayer, professional fellowship, sharing verified documents and respectful dialogue with school authorities. Its constitution, office bearers and meeting arrangements still need to be established. Membership does not itself confer authority to enter a school, alter timetables or use premises.
Why are some Sinhala and Tamil downloads missing?
Only identified editions are linked. A missing button means that edition has not been verified here, not that it does not exist. Use the official archives below or request a copy from the issuing authority. Match document number, date, schedules and amendments before comparing translations.

Help complete the collection. Needed: verified Sinhala and Tamil copies of the takeover legislation and related circulars; each Kandy school’s relevant orders; and current instructions on Catholic religious education. Send the complete document with its number, date, issuing authority and official source to the Diocese for review. A forwarded excerpt alone may omit important conditions.
